Par un jugement du Tribunal de première instance de Bruxelles, le juge a confié la garde d'un nourrisson de 10 mois au père belge. Sans lui reprocher quoique ce soit concernant ses capacités éducatives, le jugement interdit à la mère, de nationalité roumaine et française, de s'installer avec son bébé en Roumanie, son pays d'origine, où elle est titulaire d'un poste auprès de l'administration nationale. Et cela parce que "le poste à l'administration nationale n'est pas intéressant, est incertain (sans préciser quelles seraient ces incertitudes) et parce que le salaire serait inférieur au salaire qu'elle perçoit en Belgique.

Le jugement dispose également l'inscription forcée du nourisson à la crèche, sans donner aucune raison à cet égard et ceci dans un contexte où la mère est à la maison, en congé parental. La crèche est-elle un meilleur choix que la mère? De plus, selon le jugement, la mère aurait du demander l'autorisation de son ex-époux afin de prendre un congé parental. Est-ce qu'on est en Belgique ou bien en Arabie saoudite?

Le nourrisson habite chez la mère, mais le jugement fixe son domicile chez le père, sans donner aucune raison pour ce faire.

La mère est condamnée à payer au père une astreinte de 500 euros par jour en cas de non-respect du jugement. De nouveau, cette disposition n'est pas du tout motivée. Il n'y a aucune sanction prévue pour le père en cas de non-respect du jugement. De même, la mère ne peut pas quitter la Belgique avec le bébé sans l'autorisation écrite du père mais le père lui peut quitter la Belgique avec le bébé sans aucune autorisation de la mère.

Les dépositions de plusieurs fonctionnaires à la Commission européenne, apportées par le père au dossier et dont le caractère faux a été prouvé par la mère sont malgré tout prises en considération dans le jugement.

Tout cela parce que le père est belge et la mère est roumaine et française?

Nous invitons tous les Roumains et tous ceux qui trouvent que cette attitude de la justice belge est inacceptable de signer cette petition afin de demander la demission du juge et de prendre position face à la discrimination subie par une mère en raison de sa nationalité roumaine. Nous invitons également la Commission européenne à prendre des mesures contre les fonctionnaires, qui avec leurs faux témoignages portent atteinte au prestige de l'institution.

By a judgment of the Court of First Instance in Brussels, the judge gave the custody of a 10 month-old baby to the Belgian father. Without calling into question the qualities of the mother, a Romanian and French national, the judgment prohibits the mother from moving with her baby from Belgium to Romania, her country of origin, where she has a job with the national government. And this because "the position with the Romanian government is uninteresting and uncertain, and that would mean a lower salary than the current one in Belgium". The judgment does not explain why a position with a national government would be uncertain.

  Moreover, the judgment holds that the baby should be enrolled in a crèche despite the mother being at home, on parental leave. Is the crèche better for the baby than his own mother? The judgment also holds that the mother should have asked for the prior consent of the father before taking parental leave. Is this Belgium or Saudi Arabia?

The baby lives with his mother, but the judgment holds that his legal residence is at his father's place.

The mother is liable to pay a 500 euro fine a day to the father in case she doesn't respect the judgment. There is no similar sanction for the father.

The fake depositions written by officials of the European Commission, submitted by the father, and which the mother proved fake, are still considered part of the file. 

All this because the mother is Romanian and the father is Belgian?

We kindly ask all Romanians and in general all the people who agree that this judgment is outrageous to sign the petition in order to request the dismissal of judge and to take position against this blatant discrimination ! We would also like to invite the European Commission to take measures against the officials who with their fake depositions undermine the reputation of the institution. Many thanks in advance.

Printr-o hotarare a Tribunalului de prima instanta din Bruxelles, judecatoarea a incredintat un sugar de 10 luni tatalui belgian. Fara a i se reprosa nicio carenta a capacitatilor sale educative, mamei de nationalitate romana si franceza, nu i s-a permis sa plece in Romania, tara sa de origine, unde are un post de lucru stabil la administratia nationala romaneasca, impreuna cu minorul pe motivul ca postul ar fi incert, nu ar fi interesant, iar salariul ar fi mai mic decat cel pe care il are in Belgia. 

De asemenea, hotararea impune fara sa motiveze in niciun fel inscrierea sugarului la cresa desi mama este in concediu pentru cresterea si ingrijirea copilului si nu i se contesta capacitatile educative.

Cresa este deci mai buna pentru un sugar decat propria mama? Mai mult, conform hotararii, mama ar fi trebuit sa ceara acordul prealabil al fostului sot inainte de a lua concediu pentru ingrijirea copilului. Traim in Belgia sau in Arabia saudita?

Copilul locuieste la mama, dar domiciliul sau este stabilit fara nicio motivare la tata, in urma cererii acestuia. 

Mama este condamnata la o amenda de 500 de euro pe zi, de platit tatalui, in cazul in care nu s-ar conforma hotararii, fara a se motiva in niciun fel aceasta dispozitie. Tatal nu este supus la nicio sanctiune de acest gen in caz de nerespectare a hotararii. De asemenea, conform unei alte dispozitii nemotivate, mama nu poate iesi din Belgia cu minorul fara autorizarea scrisa a tatalui. Tatal poate parasi Belgia cu minorul fara autorizarea mamei. 

Depozitiile mai multor functionari ai Comisiei europene aduse de tata ca probe, al caror caracter mincinos a fost probat de mama raman la dosar si nu sunt declarate inadmisibile.

Toate acestea pentru ca mama e romanca si tatal belgian?

Rugam toti romanii si in general toti cei care sunt de acord ca aceasta atitudine a justitiei belgiene nu este tolerabila sa semneze aceasta petitie pentru a solicita demiterea judecatoarei si a lua pozitie impotriva discriminarii la care a fost supus un cetatean roman. Invitam de asemenea Comisia europeana sa ia pozitie impotriva functionarilor care prin depozitiile lor false aduc atingere prestigiului institutiei.
