This program will address identifying and managing a high-conflict custody case, both in terms of client control and litigation. Allegations of abusive or alienating behavior are common, the most basic facts are in dispute, emotions run very high, and children are often caught in the middle. Tools to help the practitioner work with his or her client will be presented, as well as methods to manage the case in court. The program will cover:
- Key factors for recognizing that a case will become high conflict;
- Managing client expectations and emotions;
- Engaging the client in positive problem-solving;
- Preparing the client for negotiation and mediation;
- Managing crises and disappointment;
- Preparing the client for court;
- Day of the hearing (behavior inside and outside the courtroom);
- Time estimates and helping client understand them;
- Presenting arguments/evidence;
- Explaining Court's order; and
- Preparation and submission of FOAH or Judgment.
