Nestor Punzalan planning to sue Top Gear Philippines

Nestor Punzalan is preparing a case against Top Gear Philippines for mistakenly implicating him in the killing of a cyclist on their Facebook page.

"'Di puwede yung sorry, sorry na lang. Grabe ang ginawa nila, dapat silang managot," Punzalan said in a report on "24 Oras" on Wednesday.

Authorities have cleared Punzalan of any wrongdoing, instead tracing the killing to another Hyundai Eon owner.

Punzalan voluntarily submitted himself to the National Bureau of Investigation (NBI) on Wednesday to deny his involvement in the shooting of a cyclist killed in a traffic incident. He proceeded to the NBI after seeing his vehicle go viral on social media.

Medical tests showed Punzalan tested negative on gun powder burns and had no bruises on parts of his body based on medical tests.  His vehicle also had no marks or scratches.

Punzalan said the incident caused him more trauma on top of the comments from netizens.

“Paparatangan nila akong killer? Parang sobrang natrauma po ako... Sa mga message or sa comments nila, medyo parang gusto na rin nila ako patayin which is nakakatakot,” he said.

The editor-in-chief of the motoring magazine earlier issued an apology for implicating Punzalan.

Meanwhile, Punzalan's legal counsel DJ Jimenez said the editor committed a form of cyberbullying pursuant to the Cybercrime Prevention Act.

"Yung tinatawag natin na civil liability, puwede silang managot sa husgado para hindi na sila tularan. Liable siya sa Cybercrime Prevention Act dahil para itong isang form by cyberbullying," Jimenez said.

Top Gear has yet to issue a statement on the case soon to be filed by Punzalan. —Joseph Tristan Roxas/JST, GMA News
