Resumo: O presente estudo busca combater uma concepção que parece ter fincado raízes no cotidiano da comunidade jurídica brasileira: a ideia de que enunciados de súmula são o texto legal já interpretado, livre de ambiguidades, e que a simples transcrição de um enunciado de súmula possa servir como fundamento legitimador de uma decisão judicial, dispensando um esforço argumentativo mais sofisticado. Situaremos paradigmaticamente essa prática, apontando os equívocos e os riscos sistêmicos de se decidirem questões jurídicas dessa maneira. O texto tem como mote demonstrar que a súmula é um instituto positivo para o direito, mas que, se mal compreendida, pode acarretar em decisões ativistas e estratégicas por parte dos julgadores. Abstract: This present study seeks to oppose a notion that seems to have taken root within the Brazilian legal community: the idea that “enunciados de súmula” are interpreted legal texts, cleared of ambiguities, and that a simple transcription of an abridgment can serve as a legitimate justification of a judicial decision, excusing a more sophisticated argumentative effort. We will paradigmatically situate this habit, pointing out the misconceptions and systemic risks involving deciding legal issues this way. The goal of the text is to demonstrate that the “Súmula” is a positive institute, but that, if misunderstood, can lead to activist and strategic decisions by the judges.
