I’ve got a 3-year old judgment for about $3K against a couple. I previously filed a garnishment against the husband but received no funds because his child support withholding is already above the state maximum garnishment rate. A few weeks ago I looked at the wife’s FB profile. She had previously been a SAH mom but FB events showed “started a new job at xxxxx.” Cha-Ching! I said. Got the first garnishment check today - $97.63. It’ll take awhile to get the money - I just hope she doesn’t quit the job.

I have another one I filed that I found on FB as well but I haven’t received any funds on it yet.

Do you have to refile garnishment every 6 months or does Arkansas have the continuous garnishment law simular to what Missouri passed a little while back.

We use FB for marketing our rentals -- set up a page for each LLC and showcase properties for rent, for sale or contract sale.

I have used FB for screening applicants, and keeping tabs on the residents and deadbeats who leave us in the lurch.

I have a question to throw out. I have an application on a prospective tenant. She has a decent job, but being young, we are requiring a parent cosign and the cosigner checks out well.

The applicant says she is going to live in the apartment by herself, but her FB page shows a "relationship" and pics of them together. The Boyfriends page shows likewise. No application from the boyfriend was received. She claims she has been living with the BF mother temporarily.

Can we ask about the boyfriend? Our concern he may not be working and will just stay around the place all day, smoke the place up with cigarettes, and basically be a pain to the other residents.

Any suggestions?

Jason B you need an answer for a person in your state.

Here in Missouri I go to the Circuit Clerk and she helps fill the papers out for me. Of course I have to have all the information such as a person's name their address where they work their work address phone number and other stuff like that. They tell me what I need I go collect it together and then she helps me fill out the papers and also mails it to where it goes. It was easy and did not need a attorney. right on tim, what an invigorating tale! it's amazing how stupid people are and how much they lob out on facebook. be sure you don't ever tell the dummy how you found her...she'll unfriend you. i like the idea of a facebook ONLY for the rental stuff, but can you have one where ALL the other tenants cannot see who each other are? i'd want them never to have any nexus of crossing paths.

this is one reason i REQUIRE checking accounts on all tenants. and a job and that for more than a year.

Getting your $$ is great ! Too bad there is no garnishment venues here in the back wards state of South Carolina . I may be wrong , but I think SC and Pa are the only such states .

I have at least $6K in certified judgement and my recourse is limited to finding out what the dead beats own and if the property exceeds a certain amount of what they can keep, then I gotta beg the Sheriff to do something. AND of course if the vehicle is registered slightly different than the name on the Court judgement ( IE exact same person , maybe middle initial is or is not on the Court judgement ) the Sheriff wont seize !

Yeah, always check on them thru FB. Always go after a money judgement and collect tru wage garnishment. I got over $3K through wage garnishment on a deadbeat skip out. I was surprised how easy it was to do myself, even in NJ where nothing is easy. --71.53.xxx.xxx

I did that through 4 job changes. This one was smart. Even my lawyer said she knew the system and had done "this" (damaging property, then not paying rent) before. I found her on FB each time with her new job announced to friends. Now she has gotten wise and doesn't have her own page but has taken over a page that was her moms. (Her mother had originally paid her rent as she went to college after 2 divorces and 2 kids...now in their 20s)So I knew this...Checking the kids FB and her monms and the newest boyfriend/fiances page. But no one puts anything on the site any more about work, jobs or where they currently reside...so I haven't been able to let the courts know where she works in order to garnish her wages. Any suggestions besides FB? It worked for 2 years despite her changing jobs every 6 months. She still owes me $2000 on this judgement and my lawyer told me to wait on the second judgement filing for damages to the apartment (another $4000)till after the first one is paid as she could have filed bankruptsy and that would have annulled both judgements. Suggestions on other ways to "find" her work place and reactivate the first judgement and start repayments again?????? PS...the courts won't automatically deduct owed monies using her license plate or SSN (both of which I had on her application)...Oh yes...the smartie has her car and a new motorcycle in her new fiances name so I can't touch them either....HELP!!!! --24.193.xxx.xx

In Indiana we have a resource--Last Known Employer. It is through the State. You have to sign up for it. You have to have a judgement. You send to the State and they can tell you their latest employer. We tracked one gal down several times through this resource. It took awhile, but we eventually got all of the judgement AND $500 in interest! --104.152.xx.xx

JB - see if your court requires an affidavit of financial means or if you can do a debtors exam.

Another thing - once you have the judgment time is on your side. Hopefully you are earning interest on the judgment. If so the best thing to do might be to lay low for awhile and see what happens.

There are companies who do asset searches. I’ve had them done in the past for around $100. I didn’t have great results so I don’t have anyone I would recommend at this point.

And unfortunately, some people manage to make themselves uncollectable.

Thanks for the tips, razorback_tim. I have a judgement against her which in NY is good for only 10 years. It's been 4 so far. In 6 more years I will need to renew the judgement in order to remain "in queue". (I'm 5th on the list of persons she owes money to including one of her exes and US govt taxes-state and local- on a horse farm she has been allowed...for some reason...to keep!!!)If I don't try to "find" where she's working...I just play the waiting game till...maybe the farm gets sold. Everything else seems to be in her fiances name so no one can touch it...plus the judgement is against her, not the fiance so he's not responsible for her debts...ever. That's what I was told by counsel. Will add your suggestions to my list of things to research come monday. Thanks! --24.193.xxx.xx
